These Terms of Service (“Terms”) govern all purchases of PowerGuard Generators products (residential backup generators, portable generators, commercial generators, inverter generators, and accompanying accessories like fuel tanks, extension cords, maintenance kits) and related services (professional installation, maintenance consultations) (collectively “Products/Services”) from PowerGuard Energy Solutions Inc. (“Company,” “we,” “us”). By placing an order via our website, authorized dealers, or customer support channels, you (“Customer,” “you”) agree to these Terms, our Privacy Policy, and all product-specific guidelines (e.g., generator operation manuals, safety protocols) provided at the time of purchase.
1. Order Acceptance & Modifications
Your order constitutes a request to purchase Products/Services, not a binding contract. We reserve the right to accept, reject, or adjust orders if: (a) Products are out of stock (due to high demand for residential backup generators during storm seasons or supply chain delays for industrial-grade engines); (b) Product details contain errors (e.g., misstated wattage, incorrect runtime specifications); or (c) your delivery/installation address is incompatible with large/heavy units (e.g., commercial 50,000-watt generators require flat, accessible entryways—remote areas with limited infrastructure may require additional shipping arrangements). A binding contract is formed only when we issue a written order confirmation (email or physical document) including item specs, total cost (taxes, shipping, service fees), delivery/installation timelines, and any required deposits.
Post-confirmation modifications (e.g., upgrading from a 5,000-watt to 12,000-watt residential generator, adding a maintenance kit) must be submitted in writing within 24 hours. We will confirm feasibility and cost/timeline adjustments (e.g.,
800 for generator upgrades, 2–4 business days for accessory additions). For bulk/commercial orders (5+ units for businesses, construction firms, or government entities), modifications are prohibited once production or shipment begins (typically 5 business days post-confirmation); cancellations result in forfeiture of the 35% non-refundable deposit.
2. Product Specifications & Safety Compliance
All PowerGuard Generators meet global safety and quality standards: ANSI/UL 2200 (U.S. generator safety), EN 12601 (EU emission and noise regulations), and AS/NZS 3000 (Australia electrical safety). Product pages and manuals clearly list key specs: wattage (1,000–50,000 watts), fuel type (gasoline, propane, diesel), runtime (8–24 hours on full tank), noise level (55–75 decibels), and weight (25–500 lbs). Minor variations (e.g., slight differences in engine sound, subtle color shifts in steel frames) are normal and do not qualify as defects.
You are responsible for: (a) Using the generator per safety guidelines (e.g., operating portable units outdoors only to avoid carbon monoxide poisoning, following wattage limits to prevent overload); (b) Ensuring professional installation for residential/commercial backup generators (improper wiring may cause electrical fires or grid damage); (c) Storing fuel in approved containers (per local fire codes). We provide safety tutorials and certification for installation partners but are not liable for injury, property damage, or equipment failure caused by improper use, unapproved modifications, or non-professional installation.
3. Payment Terms
- Methods: We accept major credit cards (Visa, Mastercard, American Express), debit cards, PayPal, and wire transfers (for bulk/commercial orders over $10,000). Commercial customers may qualify for net-60 payment terms (subject to credit approval via business license, financial records, and reference checks).
- Deposits: A 35% non-refundable deposit is required for bulk/commercial orders and custom-configured generators (e.g., diesel-powered commercial units); standard in-stock products require full payment at checkout (no deposit).
- Pricing: Prices are listed in U.S. dollars (USD) for U.S. orders, with local currency options (EUR, GBP, CAD) for international sales. Prices include applicable sales tax and emission compliance fees (excluding international orders—customs duties, import taxes, and brokerage fees are your responsibility). Quotes are valid for 10 days; prices may adjust due to material cost increases (e.g., steel, high-performance engines) or regulatory changes to emission standards.
- Late Payments: For commercial installment plans, unpaid balances incur a 3% monthly late fee. We may delay delivery, suspend maintenance services, or repossess installed units (per local laws) if payment is 20+ days overdue.

- Inspection: Inspect Products immediately upon delivery. Note damage (e.g., dented frames, cracked fuel tanks, non-functional engines) on the courier’s receipt, take photos of packaging and the product, and notify us within 48 hours. We will replace damaged items free of charge or issue a full refund; failure to report damage within 48 hours voids coverage.
5. Warranties & Returns
- Warranties: All PowerGuard Generators include a limited warranty: 5 years for residential/commercial generators (covers engine defects, frame rust, and electrical component failures), 3 years for portable generators, and 2 years for inverter generators and accessories. The warranty excludes: (a) Wear from normal use (e.g., dirty air filters, worn spark plugs); (b) Damage from neglect (e.g., lack of oil changes, improper fuel storage); (c) Repairs by non-PowerGuard authorized technicians. Extended warranties (up to 10 years for commercial units) are available for purchase at checkout.
- Returns: Standard in-stock Products (unused, in original packaging, with all parts/manuals) may be returned within 30 days for a full refund (minus shipping fees). Custom-configured generators and installed units are non-returnable unless defective (verified by our technical team), in which case we provide a replacement or pro-rated refund. Return shipping costs are the customer’s responsibility (except for defective items, where we provide a prepaid shipping label). Used generators are non-returnable (due to safety and performance risks).
